Understanding Employment-Based Visas: EB Categories Explained
Employment-based permanent residence is divided into several preference categories, each with different eligibility standards and, often, different wait times depending on your country of birth.
EB-1: Priority Workers
This category covers individuals with extraordinary ability in the sciences, arts, education, business, or athletics; outstanding professors and researchers; and certain multinational executives and managers. EB-1 does not require a labor certification, which can make it faster for those who qualify.
EB-2: Advanced Degree Professionals
EB-2 is for individuals with an advanced degree (or a bachelor's degree plus five years of progressive experience) or those with exceptional ability in their field. Most EB-2 cases require a PERM labor certification, though National Interest Waiver applicants can bypass this requirement if their work benefits the U.S. significantly.
EB-3: Skilled Workers and Professionals
EB-3 covers skilled workers, professionals with a bachelor's degree, and other workers. It also requires labor certification and generally has longer wait times, particularly for applicants from countries with high demand.
